Amendments
My Gids (“we”) may change this Privacy Policy, and if we make material changes to it, we will, through our services, or otherwise, provide notice to you to review the changes prior to the effective date.
You acknowledge that your continued use of our Website after we publish or send notice of our changes to this Privacy Policy means that the collection, use and sharing of your personal data is subject to the updated Privacy Policy.
PRIVACY POLICY
These Terms and Conditions contain the Privacy Policy applicable to the Website available at http://mygids.co.za/, programs, communications and services, including off-site services, such as our marketing services and plugins, but excluding services and payment gateways that state that they are offered under a different Privacy Policy.
As a listing owner or visitor to our site, the collection, use and sharing of your personal data is subject to this Privacy Policy and updates. (This includes our User Agreement, Cookie Policy and other documents referred to in this Privacy Policy.)
1. DATA WE COLLECT
1.1 Data you provide to us
Registration and Profile
To create a profile, you must provide data, including your name, email address, contact number, and a password. If you register as a listing owner, you must provide payment (e.g. credit card) and billing information (such as the registered name of your business and postal address) and other relevant business information to market your services and products.
You create your My Gids profile yourself and you can maintain your profile and make changes as needed. (A complete profile helps you make the most of our services).
Post and upload
We collect personal data from you when you provide, post or upload it to our website, such as when you fill out a form to register as a listing owner. If you choose to share your contact details with us, we will link to your website to give visitors access to information provided by you to grow your business.
1.2 Data from others
Content and news
You and others may publish content that contains information about you, including articles and comments on our website. We will not publish any negative comments about you and your business until you have had the opportunity to provide corrective comments or steps that will benefit your business.
Contact information
We may receive personal information (including contact information and photos) from you for your listing. This information will be available to the public.
Customers and Links
We may receive personal information about you when you use our clients’ services. (listing owners) We may also receive personal information from you if you are a customer of one of the service providers in the industry we are contacting.
1.3 Service use
We record your visits and use of our website, such as when viewing content or clicking on links, searching, sharing articles or listings on social networks, or commenting on articles and giving reviews. We use subscription records, cookies, device information and Internet Protocol (“IP”) addresses to identify you and monitor your usage.
1.4 Cookies, and other similar technologies
As further described in our Cookie Policy, we use cookies and similar technologies (e.g., Web beacons, pixels, ad tags, and device identifiers) to recognize you and / or your device (s) on, off, and across different services and devices. We also allow others to use cookies as described in our Cookie Policy. You can control cookies through your browser settings and other tools. You can also opt out of our use of cookies and similar technologies that track your behavior on the other third-party ad sites.
1.5 Your device and location
We receive data from your devices and networks, including location data. When you visit or leave our services (including our add-ons or cookies or similar technology on other websites), we receive the URL of both the website you came from and the one you go to next. We also obtain information about your IP address, network server, operating system, web browser and add-ons, device identifier and features, and / or ISP or your mobile service provider. If you use our services from a mobile device, that device will send us data about your location based on your mobile device’s settings. We will ask you to sign in before using GPS or other tools to identify your exact location.
1.6 Messages
We collect information about you when you send, receive or interact with our services. For example, if you receive a My Gids connection request, we will monitor whether you responded and may send you a reminder. We also use automated scanning technology on messages.
1.7 Social networks
We receive information that is linked to our plug-in service, advertising, cookies or similar technologies and when we offer services and products that you believe will be of interest to you or for your benefit, we will introduce the products and services to you with the free choice to use it or unsubscribe from the service.
1.8 Websites and Services of Others
We receive information about your visits and interactions with services provided by others when you sign up for My Gids or visit other services that include our plug-ins (such as “Share on My Gids”), advertisements, cookies or similar technologies.
1.9 Other
We are constantly improving our services, which means we get new data and create new ways to use data. Our services are dynamic, and we often introduce new features that may require the collection of new information. If the type of personal data we collect, or the way we use your data, materially changes or changes, we will notify you and amend this Privacy Policy accordingly.
2. HOW WE USE YOUR DATA
How we use your personal data will depend on what services you use, how you use the services and the choices you make in your settings. We use your data to provide, support, personalize and develop our automated systems to make our services (including advertising & marketing) more relevant and useful to you and other users.
2.1 Services
Our services connect you to others. Others can find you and help you grow your business. Our services keep you up to date with news, events and introduce new trends in the Eastern Free State, that could benefit your business. We use your data to authorize access to our services. We set the platform for business owner (“listing owner”) and client (“visitor”) to be in contact and promote their business and business of choice.
It is your choice to invite others to use our services, send a connection request or share your listing of information on social networks and other platforms. When you invite someone to contact you, your invitation will include information such as your name, business name, photo(s) and contact information.
We use the information we have about you (e.g. data you provide and data we collect from your involvement with us based on relevant content and comments on our services) to track your next interest. We may therefore use this information to suggest that you follow certain listings on our website or make recommendations that will be to your advantage to follow your interest.
Keeping your profile accurate and up-to-date can help you better connect with others and promote the opportunity to grow your business.
2.2 Additional Services
Articles
We welcome articles (including media such as photos, videos and other promotional material) about news and events in our region that will extend to the different business industries as a whole.
2.3 Communication
We enable and promote communication between ourselves, listing owners and visitors. We offer the opportunity to subscribe to our newsletter and you can at any time exercise your right to unsubscribe and request to be removed from the newsletter list.
We will connect with you via email, cellphone and notifications and marketing material posted on our website or social networks. We will communicate to you about the availability of our services, security or other service related issues. We also send communications on how to use the services, network updates, reminders, and promotional messages from us and our partners. Our communication to you provides further opportunity for mutual interaction and strengthens our relationship with you.
2.4 Advertisements
We will not disclose personal information to any third parties without your consent, unless such action is required by law, by way of subpoena or applicable law or regulation.
No one may send unsolicited emails to members of the public in response to queries they have received through our website. This includes any other products or businesses. By disregarding this policy, our Privacy Policy, and the business we provide to the public, that their contact information will not be used for any purpose other than responding to the query they made for potential business with the listing owner, is harmed.
We offer you the choice and opportunity of personalized advertising and marketing material on your listing that can be shared by visitors on social networks.
2.5 Marketing
We use data and content from listing owners and visitors for marketing invitations and communications that will promote the network, growth and involvement of others in our services to you and various industries as a whole.
2.6 Developing services and research
We use data, including public feedback, to conduct research and development for the further development of our services to better serve you and others, provide more intuitive and personalized experience, drive membership growth and engagement, and liaise between business owners and clients and to promote.
2.7 Client Service
We use the data (which includes your communications) to help you investigate and respond to complaints, compliments and improve your service delivery.
2.8 Collective insight and statistics
We use data to generate insight into statistics. For example, to generate statistics on the number of visits to the website, by category and / or listing and other topics, so that targeted marketing campaigns can be launched that will benefit the network as a whole.
2.9 Security and Investigations
We use your data if we believe it is necessary for security purposes or to investigate possible fraud or other breaches of our User Agreement or this Privacy Policy and / or attempts to harm our listing owners or visitors.
3. HOW WE SHARE INFORMATION
3.1 Our Services
Primary Service: Listing Marketing
The information you complete as a business owner on your application form, with the exception of your email address (which is hidden for protection against unwanted spam), is fully visible to all visitors to your listing on our website. This includes information you provide about your business (e.g., your name, business name, address, location, description of your business, contact information, photos, services and facilities). The accuracy of this information is your responsibility and you can edit, the information and photos at any time. (Refer to our Q&A for inquiries on how to edit your listing information)
Secondary service: Interactive marketing
All entries will be edited by us before comments, articles or reviews are published on our website. Listing owners, article authors, and diary organizers will be offered the opportunity to provide corrective action or comment on any negative feedback or reviews before such feedback is published. In accordance with the Terms & Conditions par. 13, we reserve the right to edit all comments and reject and not publish obscene language, discriminatory or incriminating comments.
3.2 Legal Services
We may need to share your data when we believe it is required by law or will help protect the rights and safety of My Gids, yourself or others. We may need to provide information about you when required by law, subpoena, or other legal process, or if we are satisfied that disclosure is reasonably necessary to (1) investigate, prevent or act on suspected or actual illegal activities or to assist government agencies; (2) maintain our agreements with you, (3) investigate and defend ourselves against any third party claim or allegation; (4) protect the security or integrity of our service (such as sharing with companies that have similar threats); or (5) exercise or protect the rights and safety of My Gids, our members, staff, or others. We endeavor to notify members of legal claims for their personal data, if applicable in our opinion, unless prohibited by law or court order or when the request is an emergency. We can dispute such claims if, in our sole discretion, we believe that the requests are outrageous, vague, or lack proper authority.
3.3 Change in control or sale
We may share your data when selling our business to others, but it must still be used in accordance with this Privacy Policy. We may also share your personal data as part of a sale, merger or change in control, or in preparation for any of these events. Any other entity that buys us or any part of our business will have the right to use your data, but only in the manner set forth in this Privacy Policy, unless you agree otherwise.
4. YOUR CHOICES AND OBLIGATIONS
4.1 Data Retention
We retain your personal data for as long as your profile exists or we need to provide our services to you. This includes data that you or others have provided to us and data generated or derived from your use of our services. Even if you only use our services when you search for businesses and read our articles, we retain your information until you decide to close your profile.
4.2 Your rights to access and control your personal data
We offer you the choice of how your personal data is collected, used and shared.
Right to access data:
You can ask for a legible copy of your personal data you provided.
Editing and editing data:
You can edit some of your personal data through your account and update inaccurate data.
Restriction of use of data:
You may request us to stop using some or all of your personal data (e.g. if we have no right to use it) or to limit our use of it (e.g. if your personal data is kept inaccurate or illegal).
Delete data:
You may ask us to delete some or all of your personal data if you believe that it is no longer necessary for us to provide you services.
4.3 Account closure
We keep track of your data even after you close your account. If you wish to close your My Gids profile and delete your listing, your personal and business information will generally no longer be visible to others on our services within 24 hours. We retain your personal data even after you close your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), comply with regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, our User Agreement to maintain, or complete your request to “deregister” any further messages from us. Information you have shared with others (e.g., comments, articles, reviews and ratings) remains visible after you close your account or delete the information from your own profile. We do not control data that other persons have copied from our services.
5. OTHER IMPORTANT INFORMATION
5.1. Security & Credit Card Privacy
Except as otherwise provided in this Privacy Policy, the rules, processes and procedures of PayFast (Pty) Ltd and the relevant banks for the payment, verification and association of your credit card apply to all payments and transactions on My Gids and your rights and obligations regarding payments due to or by you, and will be governed accordingly. We take all possible steps to ensure that payments made with a credit card on My Gids are secure. The primary measures taken to ensure this security are as follows:
Credit card transactions will be processed and authorized via PayFast (Pty) Ltd which is the approved payment gateway for My Gids payments. We do not store any credit card details on our system. No credit card details will ever be sent via unsafe methods such as email.
